On February 23, 2006 the Supreme Court of Canada released its decision in Canadian Pacific Railway Co. v. Vancouver (City) (B.C.) (30374) and in doing so confirmed that the City of Vancouver, in exercising its broad planning powers under the Vancouver Charter, is not required to compensate the Canadian Pacific Railway for an official development plan bylaw’s effect on CPR’s land.
